Privacy policy
BRILLIANT SUCCESS VISA AND EDUCATION PTY LTD (ABN 78 649 700 765), trading as SOGO Migration, is bound by the Australian Privacy Principles under the Privacy Act 1988 (Cth). This policy explains how we handle personal information.
What we collect
We collect the personal information needed to provide immigration assistance. Depending on the matter this may include identity and contact details, immigration and travel history, employment and education records, financial information, health and character information, and information about family members and sponsors. Some of this is sensitive information within the meaning of the Act; we collect it only where it is reasonably necessary and, where required, with your consent.
How we use it
We use personal information to assess and prepare your matter, to lodge applications and correspond with the Department of Home Affairs, review bodies, skills assessing authorities and other relevant agencies, to meet our professional and record keeping obligations as a registered migration agent, and to communicate with you about your matter.
Disclosure
We disclose personal information to the Department of Home Affairs and other government agencies as required to progress your matter, to skills assessing authorities, and to third parties you authorise (for example an employer sponsor, a translator, or a panel physician). We do not sell personal information. Where information is disclosed overseas, it is generally to an overseas authority or document issuer connected with your own application.
Storage and security
Records are held in electronic and, where applicable, physical form, with access limited to those who need it. We are required to retain client records for the period prescribed by the Code of Conduct applying to registered migration agents.
Access, correction and complaints
You may request access to the personal information we hold about you, and ask us to correct it if it is inaccurate. Write to info@sogovisa.com. If you are not satisfied with our response to a privacy complaint, you may complain to the Office of the Australian Information Commissioner.
Website
This website does not use advertising or tracking cookies. Web fonts are loaded from Google Fonts, which involves a request to Google's servers from your browser. Enquiry form submissions are sent by email to our practice address and are not stored by any third party service.
Terms of engagement
These terms describe how we work. They do not replace the written services agreement provided before we act, which governs any particular matter.
- No engagement until agreed in writing. Enquiries, initial discussions and preliminary assessments do not create a client relationship. We act only once a services agreement is signed and any required initial payment is received.
- Scope. The services agreement sets out what is included. Work outside that scope is quoted separately before it is undertaken.
- Fees. Professional fees are quoted as fixed amounts per stage. Government charges, including visa application charges and any levy, are set by the Department and are payable in addition. Third party costs such as skills assessment fees, health examinations, police checks and translations are also payable by you unless expressly stated otherwise. Certain sponsorship-related costs must by law be borne by the sponsor and are not passed on to a visa applicant.
- Your obligations. You must provide complete and accurate information and documents, and tell us promptly of any change in your circumstances. Applications are decided on the material before the decision maker; incomplete or inaccurate information can lead to refusal and, in some cases, to a bar under PIC 4020.
- No guarantee of outcome. All decisions are made by the Department of Home Affairs, a review body or another authority. We do not and cannot guarantee any outcome or processing time.
- Communication. We correspond by email unless agreed otherwise. It is your responsibility to keep your contact details current and to check for correspondence, including time-limited requests.
- Termination. Either party may end the engagement in writing. Fees for work completed to that date remain payable, and unearned amounts are refunded in accordance with the services agreement and the Code of Conduct.
- Complaints. Raise any concern with us in the first instance at info@sogovisa.com. Complaints about a registered migration agent may also be made to the Office of the MARA.
